Trademark renewal is crucial to maintaining brand’s legal protection. If owner of the Trademark forgets to renew, the Registrar may remove the trademark from the register. This means serious consequences, affecting not only owner but also anyone with a license to use the trademark. Failing to renew degrades brand/mark’s legal standing and exclusivity rights.
The Trademark Act is considerate. If owner misses the renewal, he has a second chance within six months. He has to submit form TM-R and pay the surcharge to keep enjoying the benefits of exclusivity and prevent others from using mark.

The solution to renew the trademark which are expired
- a) Restoration of trademark: If missing the renewing of a trademark, restoration is an option. According to Section 25(4) of the Trademark Act of 1999, anyone can apply for the restoration of a trademark after its removal from the Trademarks Register. So, if renewal slips the mind, restoration has the situation covered!
- b) Interlocutory Petition: Interlocutory petition can be filed before removal of the Trademark from the Trademarks Register as a legal recourse for seeking permission of the Registrar to apply for renewal after the expiry of six months from the date of validity.

Motwane Private Limited vs The Registrar Of Trade Marks on 16 February, 2024
- In the judgment, the Bombay High Court allowed the writ petition filed by “Motwane” Pvt Ltd. against the Registrar of Trade Marks. The petitioner sought relief under Article 226 of the Constitution of India regarding the non-renewal of three trademarks.
- The court emphasises the significance of Section 25 of the Trade Marks Act, stating that the Registrar is obligated to send notice before the expiration of the last registration, outlining conditions for renewal. In the absence of such notice and considering the continuous presence of the trademarks on the register, the court holds that the petitioner retains the legal right to seek renewal.
- As a result, the court quashed the communication stating that the petitioner’s applications cannot be renewed due to a delay of more than one year.
